Declaration of Harta Sepencarian
Property acquired by husband and wife during the subsistence of a valid marriage, may, under certain circumstances, be considered as "harta sepencarian" and when this applies, the surviving spouse is entitled to claim a certain portion thereof from the deceased spouse's estate in priority to the Faraid rules.
It is not uncommon for certain beneficiaries of a Muslim deceased to dispute a surviving spouse's harta sepencarian claim. To avoid the rancour and other unpleasantness that might arise among the beneficiaries after the testator’s death on this issue, as-Salihin has devised documents which would go a long way to alleviate such predicament.
