Hibah means gift. In Islam, a gift is a gratuitous transfer of property under specific conditions. When such transfer is made with the intention of obtaining recompense in the hereafter, it is called a sadaqah. When the gift is brought to the donee to manifest one's respect for him, it is a hadiah.
The giving away of gifts is encouraged in Islam. As the Prophet S.A.W has said:
| "Exchange gifts among yourself and thus strengthen mutual love, with each other."
"Give present to one another because a present removes grudges." |
A person may lawfully make a gift of his property to another inter vivos, i.e. during his lifetime, unfettered as to quantum. However, when he does so by a Wasiat, such testamentary disposition is limited to one-third of his net estate.
